Kerseys has been a client of Auditel for several years. We understand how Auditel works and we appreciate the benefit of the services which Auditel affiliates provide. We are also very familiar with Auditel’s standard form consultancy agreements, having assisted a number of affiliates to recover unpaid fees due to them, whether by negotiation or by formal court process, or a combination of both.

Our dispute resolution solicitors Anthony Wooding and Ross Burkitt are highly experienced and approachable and they are praised in the Legal 500 for their wide range of knowledge, prompt responses and clear advice.
We are keen to foster a working relationship with Auditel affiliates and as such we are happy to provide the following services, including free initial telephone discussions at specific key stages in the recovery/enforcement process.

Pre-action advice

If you have a dispute or a potential dispute with one of your clients we are happy to act as a ‘sounding board’ via a free initial telephone discussion with one of our dispute resolution solicitors.

Debt recovery service

If you have unpaid invoices our debt recovery department can send letters before action on a ‘no win, no fee’ basis. If the letter before action is successful and results in recovery of all or part of the debt, our fee will be 5% of the sum recovered, subject to a minimum of £20 per claim, plus VAT.

If the letter before action is not successful you need not pay us anything and you will need to decide whether you wish to instruct us to issue county court proceedings against the debtor on your behalf. In that event, we will charge a fixed fee of £110 plus VAT to initiate the proceedings, through to entry of judgment in default of any response.

If the claim is contested by the debtor, it will be passed to one of our dispute resolution solicitors who will advise on the next steps, provide an estimate of the costs to be incurred and assume conduct of the claim for you thereafter if you so wish.

Enforcement action

Once a judgment has been obtained, one of our dispute resolution solicitors will advise on the enforcement options and provide an estimate of the likely costs to be incurred. We can also help with the enforcement process if you so wish.
