As Taylor Swift and Travis Kelce take their love story to next chapter will there be a Pre-Nuptial Agreement.

Whether or not you are a “Swiftie”, you will have heard the news of the engagement of Taylor Swift to American footballer Travis Kelce on 26 August 2025. Whilst no doubt they will be busy enjoying their engagement and making plans for their wedding, one of the items on the checklist may be the consideration of whether they should enter into a pre-nuptial agreement. It is certainly a popular thing to do in America, and given the wealth they have both amassed over their successful carers (Taylor Swift with a net worth of approximately $1.6 billion and Travis Kelce with a net worth of approximately $70 million) a pre-nuptial agreement is certainly something their advisors will be pushing them to do. Having one in place will be advantageous should things go wrong. The pre-nuptial agreement will provide for financial certainty and potentially avoid a costly, public dispute through the courts and avoid any Bad Blood between them.

Whilst in many States in America, pre-nuptial agreements are binding, this is not the position in England and Wales.

However, since the case of Radmacher in 2009, the courts have been more willing to give significant weight or uphold a pre-nuptial agreement provided certain criteria has been adhered to. This includes, where the court can be certain that the agreement has been freely entered into; the parties have exchanged fully and frankly their respective financial disclosure and that both parties have had the opportunity to seek independent legal advice.

As a result of Taylor Swift’s and Travis Kelce’s wealth, they are an ideal candidate for a pre-nuptial agreement. However, it is not just for the super wealthy and often the benefit of a pre-nuptial agreement or more over, a post-nuptial agreement (an agreement made post marriage) is overlooked by many, even though their circumstances dictate that they would benefit from having one in place.

A pre or post-nuptial agreement may be just what you need in the following circumstances:

  • If you want to protect assets obtained prior to the relationship; or
  • Where you retain assets from a previous marriage; or
  • If you want to protect your inheritance (received or anticipated); or
  • If you want to provide for children from a previous relationship or a current relationship.

Often a pre or more often a post-nuptial agreement is something to consider when you are in the process of making or updating a Will (due to a significant change in circumstances).
